Terms of Service & Anti-Spam Policy

Access to and use of the Kontacta platform (available at kontacta.net and app.kontacta.net) are governed by these Terms and Conditions of Service.

1. Scope of the Service

Kontacta provides a SaaS and self-hosted platform for sending newsletters, email marketing campaigns, transactional messaging, automations, and subscriber list management.

2. Tenant Account & Approval

The activation of every new corporate Tenant account is subject to prior registration and administrative approval to guarantee IP reputation and prevent misuse of sending infrastructure.

3. Anti-Spam Policy & Mandatory Opt-In

The use of Kontacta for sending unsolicited emails (SPAM) is strictly prohibited. Specifically:

• Importing or utilizing purchased, rented, or third-party scraped subscriber lists is strictly prohibited.
• All recipients must have provided explicit, prior consent (Opt-In or Double Opt-In).
• Every email dispatched through the platform must include a functioning 1-click unsubscribe link and valid sender contact information.

4. Sending Quotas, Thresholds & Suspension

Kontacta enforces hourly and monthly sending limits along with automated monitoring of bounce and complaint rates. Exceeding acceptable thresholds or violating anti-spam policies will result in immediate tenant suspension.

5. Service Availability & Limitation of Liability

The platform is provided 'as is'. While striving for maximum uptime and reliability, the provider is not liable for deliverability failures caused by third-party mailbox filters, incorrect user DNS configurations, or upstream network outages.
